 Adultery damages a thing of the past – SCA
Five SCA judges have found that the existence of damages claims based on adultery is no longer justified. ‘It has become outdated and can no longer be sustained – the time for its abolition has come,’ said Judge FDJ Brand yesterday, according to a report in The Mercury. The matter of the relevance of adultery damages was sparked by an appeal in which a man was ordered by the High Court sitting to pay R75 000 in damages to his rival, for alienation of affection of the latter’s wife. Before hearing the merits, the judges asked to be addressed on whether such claims should remain on the law books, weighed against the morals of a modern society, the Constitution and the concept of marriage. Brand said: ‘Let me say that I have no doubt that marriage is one of the most important institutions in our society… which is protected by our Constitution… But the question is, if the protection of marriage is one of the main goals, is the action (for adultery) successful in achieving this goal?’ He upheld the appeal, stating that the plaintiff’s wife was unhappy long before she met her new lover and that the latter was not the reason why she had divorced.
